Madde 11 - Teminata ilişkin hükümler
11.1. Kesin teminatın miktarı ve süresi:

11.2. Ek kesin teminat:
11.2.1. İş artışı olması halinde artış tutarının %2’si oranında teminat olarak kabul edilen değerler üzerinden ek kesin teminat alınabileceği gibi hakedişlerden kesinti yapılmak suretiyle de karşılanabilir. Ek kesin teminat mektubu da süresizdir.
11.2.3. Yüklenici tarafından verilen kesin ve ek kesin teminat, 4734 sayılı Kanunun 34 üncü maddesinde belirtilen değerlerle değiştirilebilir.
11.3. Kesin teminat ve ek kesin teminatın geri verilmesi:
11.3.1. Taahhüdün, sözleşme ve ihale dokümanı hükümlerine uygun olarak yerine getirildiği ve Yüklenicinin bu işten dolayı İdareye herhangi bir borcunun olmadığının tespiti ve garanti süresi dolduktan sonra kesin ve varsa ek kesin teminatın tamamı Yükleniciye iade edilir.

Madde 12 - Ödeme yeri ve şartları
12.1. Ödeme yeri
12.1.1.İdare tarafından sözleşmeye ilişkin ödemeler MEB Merkez Saymanlık Müdürlüğünce yapılacaktır.
12.1.2.Yüklenici tarafından alım konusu malın, sözleşme ve ihale dokümanına uygun şekilde teslim edilmesi koşuluyla ödemelere ilişkin hususlar ve ödeme zamanı aşağıda düzenlenmiştir.
12.2. Ödeme koşulları ve zamanı
12.2.1. Ödemeye esas para birimi Türk Lirası’dır.
12.2.2. Ödemeler:
Merkez Muayene ve Kabul Komisyonunca yapılacak muayene ve kabul işlemlerinden sonra tablet bilgisayar setlerinin ilgili bütün okullara/ MEB İl Müdürlüklerine istenilen şartlarda tam olarak tesliminden sonra, bu okullarda düzenlenecek kontrol ve teslim tutanağının İdareye ulaştığı tarihten itibaren Merkez Muayene ve Kabul Komisyonunca yapılacak muayene ve kısmi geçici kabul işlemlerinden sonra sözleşme bedelinin ilgili kısmının %95’ı ödenecektir.
Sözleşme bedelinin ilgili kısmının bakiyesi olan % 5’lik bölümü kesin kabul işlemlerinin tamamlanmasından sonra ödenecektir.
12.2.3. İdare, Merkez Muayene ve Kabul Komisyonunca kısmi geçici kabul raporu düzenlenmesinden itibaren Yüklenicinin yazılı talebi üzerine en geç 30 gün içinde Yükleniciye veya vekiline ödemeyi yapacaktır.
12.2.4. Kısmi kabulün yapıldığı hallerde her bir kısmın teslimatında aynı usuller uygulanacaktır.
Madde 13 - Avans verilmesi şartları ve miktarı
